Welcome to The Happy Camper Roadside Assistance mobile application (“App”). These Terms and Conditions (“Terms”) govern your use of the App and the services provided by The Happy Camper Roadside Assistance (“Company,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the App.
1. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.
2. Services Provided
The App offers users access to roadside assistance services, including but not limited to:
- Towing
- Tire changes
- Jump starts
- Lockout assistance
- Fuel delivery
- RV-specific support
Service availability may vary based on location, time of day, and other factors.
3. Account Registration
To access services, you may be required to create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your account and for all activities under your account.
4. Fees and Payments
Some services may require payment. Fees will be clearly communicated before you confirm a service request. By submitting your payment information, you authorize us to charge the applicable fees to your selected payment method.
5. Cancellations and Refunds
You may cancel a service request at any time before the service provider is dispatched. Refunds may not be available after dispatch. If a service provider is unable to complete a service due to your failure to provide accurate information or be present, you may still be charged a service fee.
6. Third-Party Service Providers
Our roadside assistance services are performed by third-party contractors. We are not responsible for the acts or omissions of these providers but will make reasonable efforts to ensure quality service. If you encounter an issue, please report it to us.
7. User Conduct
You agree not to:
- Use the App for unlawful purposes.
- Interfere with or disrupt the App or servers.
- Provide false or misleading information.
- Attempt to access accounts or data not intended for you.
We reserve the right to suspend or terminate your access to the App for any violation of these Terms.
8. Intellectual Property
All content, trademarks, logos, and intellectual property on the App are owned by or licensed to us. You may not use, reproduce, or distribute any part of the App without our prior written consent.
9. Disclaimers
The App is provided “as is” and “as available.” We do not guarantee that services will be available at all times or in all areas. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
10. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the App or services.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, or expenses arising out of your use of the App or violation of these Terms.
12. Privacy
Your use of the App is also governed by our Privacy Policy. Please review it to understand our data practices.
13. Changes to Terms
We may update these Terms from time to time. Changes will be effective upon posting. Continued use of the App after changes means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of Nevada, without regard to its conflict of laws principles.
